Drittend Es ist dieses mein Wille und Verlangen daß die Ketty Heÿson welche ich als meine eigen Kind angenommen, nach meiner Frau ihrem Todte alles dasjenige welches Sie hinterlaßt ihr Ererben soll, dabeÿ sie aber verbunden ist, meiner Frauen allen Gehorsam zu leÿsten welchen sie nach Pflicht so lange sie sich unter ihren Aufsicht befindet schuldig ist zu beobachten auch nicht ehender oder, mit gewalt an irgent einer Sache auspruch zu machen es seÿ dann mit meiner Frauen freÿen bewilligung bis nach ihren Todte; Solte aber die Ketty ehender als meine Frau sterben so mag die Betsey als ihre älteste Scwester an ihre stelle treten und so wie ihr Schwester mit Gehorsam daß ihrige erben. Solte sie aber dieser nicht bewilligen so sollen die Ketty ihre Geschwister eins wie das andere ihre Schwester erben. This Day the Last Will of Jacob Heyson was moved in due form of Law on the Oath of John Kniese & John Zwicker two of the Subscribing witnesses, the [Exce] & Probate was Granted to Mary Gertraut his widow in the said will she being sworn faithfull to Execute the Trust.... The following is a paraphrased translation [by Christa Mölting] of the above will of Jacob Hyson:
In the Name of God, Amen.
I Jacob Heyson in the Township of Lunenburg, Province of Nova Scotia, proprietor, have as a good Christian consideration to write my last Will. I am of complete sound of mind (Bless the Lord to Eternity). I experience a weakness of my body and my thoughts are going in the direction that I will give my soul into the Hands of Almighty God and that my body be returned to the earth, in a Christian-like manner, from which it came. Because of the above feelings I am writing my last will and testament. First I bequeath by the authority which is mine to my honoured wife Maria Gertraut Heyson three pieces of land (called the Mill Grant) the House, Barn, Stables and all things and property which I received from my Father Philip Heyson. This is my wish and last will that my wife receive the above after my death, except if she decides to get married again. Second, I leave to my wife all my moveable and personal property in the house, barn, stables, etc. after my death. In case she gets married again then all my property, except what is legally hers, goes to my brother Heinrich [Henry] and his children. Third, it is my will and desire that Ketty Heyson who I adopted receive everything I leave to my wife after her death. But she has to promise that she obeys and isnot disloyal to my wife. Also promise not to take anything that is not legally hers except if my wife gives it to her. But if Ketty Heyson dies before my wife, I wish that Betsey her oldest sister inherit after my wife's death. In case my wife does not grant the inheritance to Betsey, then I wish Betsey's brothers and sisters should receive it. Fourth, it is also my last wish to leave to Johan Michael Berghaus Twenty-five Pounds local currency after my wife's death. He will only receive the above amount if he obeyed and was loyal to my wife. Finally I order and wish that my best friend John Heckman and my wife are the executors of my last wishes. All previous will are recalled and invalid and I Jacob Heyson, herewith state and certify my last will with my Hand and Seal at Lunenburg on the first of March in the year of our Lord One thousand Eight Hundred thirteen.

From the will it appears that Jacob and Maria Gertraut adopted a girl named Ketty. It does not state the relationship between the Heysons and Ketty’s siblings. It may be implied that the siblings were not adopted by the Heysons. The will does not state the relationship of Johan Michael Berghaus to the Heysons or to Ketty, Betsey and the other unnamed siblings.
